This privacy policy (the “Privacy Policy”) describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You visit and/or use Our Service through the website located at www.buya.com and/or the Buya mobile software application and tells You about Your privacy rights and how the law protects You.
We have created this Privacy Policy to tell You what information the Website and/or App collect, how we use that information, and who we will share that information with, if at all. This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. Capitalized terms not defined in this Privacy Policy will have the meaning set forth in our Terms of Use. By visiting and/or using the Website, App, and/or Service, You are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use Agreement. We encourage You to read the Privacy Policy, and to use the information it contains to help You make informed decisions.
We collect, use and are responsible for certain Personal Data about you to provide and improve the Service. When we do so we are subject to various laws in the United States, in the European Union (where the General Data Protection Regulation applies), and the United Kingdom (where the UK version of the GDPR applies), and we are responsible as “controller” of that personal information for the purposes of those laws.
By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

- Account means a unique account created for You to access our Service or parts of our Service.
- App means the Buya mobile software application.
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to Bravo Store Systems LLC, 1865 Village Center Cir, Las Vegas, NV 89134.
- Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
- Personal Data is any information that relates to an identified or identifiable individual.
- Service refers to any of the features, services, and/or programs offered by Company which are accessible through the Website and/or the App.
- Service Provider means any third party who processes data on behalf of the Company including third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used. The term shall also include third parties using the Company’s Bravo Store Systems™ point-of-sale operating system software and in connection with which the Company is able to provide certain of the Services to You.
- Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- Website refers to the Company’s online website located at www.buya.com.
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Collecting and Using Your Personal Data
Types of Data Collected
We make no representations regarding, and disclaim all liability arising out of, or related to, the accuracy or completeness of the information we collect and disclose through the Service.
Personal Data
We only receive or collect information that identifies You personally if You choose to provide such personally identifiable information to us as part of your access to and/or use of the Service. When You sign up to become a user or contact us or in the course of using the Service, You will be required to provide us with Personal Data about yourself. Such Personal Data may include, without limitation, your name, e-mail address, physical address, phone number, including for account-related communications such as SMS, where consent is provided, transactional information (based on Your use of the Service), geolocational information, and such other information. Except as otherwise described herein, we do not collect any Personal Data from You when You use the Service unless You provide us with the Personal Data voluntarily.
We may collect and store the following Personal Data:
- shipping, billing and other information you provide to purchase or ship an item;
- any information you provide in connection with any use or transaction conducted utilizing the Service;
- community discussions, chats, dispute resolution, correspondence through our Service, and correspondence sent to us;
- additional information we ask you to submit to authenticate yourself or if we believe you are violating the Terms of Use Agreement, Privacy Policy, or any other policies (e.g., we may ask you to send us an ID or bill to verify your address, or to answer additional questions online to help verify your identity or ownership of an item you list);

- other supplemental information publicly available and/or lawfully obtained from third parties.
Usage Data
Usage Data is collected automatically when visiting the Website and/or using the Service. Usage Data may include transactional information based on your usage of the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages or parts of our Service that You visit or access, the time and date of Your visit, the time spent on the Service, unique device identifiers and other diagnostic data.
When You access the Service by or through a Device, We may collect certain information automatically, including, but not limited to, the type of Device You use, Your Device unique ID, the IP address of Your Device, Your operating system, the type of Internet browser You use, unique Device identifiers and other diagnostic data. We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a Device.
Geolocational Information
Certain features and functionalities of the Service are based on your location. In order to provide these features and functionalities while You are using your Device, we may, with your consent through Location enabling, automatically collect geolocational information from your Device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”). Collection of such Geolocational Information occurs only when the Website and/or App is running on your Device. You may decline to allow us to collect such Geolocational Information, in which case we will not be able to provide certain features or functionalities to you.
Information from Third-Party Social Media Services
The Company may allow You to create an account and log in to use the Service through the following Third-party Social Media Services:

Use of Your Personal Data
The Company may use Personal Data for the following purposes:

- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
- For the performance of a contract: the development, compliance and undertaking of the contract for the products or services Us through the Service.
- To contact You: To contact You by email, telephone calls, SMS where You have provided consent, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
- To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that You have already purchased or enquired about unless You have opted not to receive such information.
- To manage Your requests: To attend and manage Your requests to Us.
- For business transfers: To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

- Use of Artificial Intelligence Tools: The Company may use artificial intelligence–enabled tools and features to support and enhance the Services, including tools that assist with data analysis, recommendations, valuations, or operational efficiencies. In some cases, use of these tools may involve processing data through third-party technology providers subject to their own terms and privacy practices. The Company does not use Personal Data to train publicly available artificial intelligence models unless expressly disclosed. Any outputs generated through AI-enabled features are intended to assist users and do not replace human judgment or decision-making.
We may share Your Personal Data in the following situations:
- With Service Providers: We may share Your Personal Data with those Service Provider to whom You choose to make an offer to purchase goods and services and from whom You choose to purchase goods and services in connection with Your use of the Service and/or with Service Providers to whom You choose to engage in a transaction in connection with Your use of the Service. We may also share Your Personal Data with Service Providers in connection with Your use of the Service and/or to monitor and analyze the use of our Service and to contact You.
- Use of Company Services by Business Customers: Company provides software and technology services to businesses, including pawnshops, that use the Services to interact and communicate with their customers. In these cases, Company processes Personal Data on behalf of such business customers in accordance with their instructions, including facilitating communications sent by those businesses to consumers through the Services.
- For business transfers: We may share or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- With Affiliates: We may share Your Personal Data with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
- With business partners: We may share Your Personal Data with Our business partners to offer You certain products, services or promotions.
- With other users: when You share Personal Data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.
- With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
- With third parties for direct marketing: We do not sell Your Personal Data. We may disclose Personal Data to third-party service providers and business partners that integrate with or support our Services, including payment processors and other financial service providers. In certain cases, these third parties may use the information provided to contact You regarding their own products or services, subject to their own independent privacy policies and agreement with You. Company does not control, and is not responsible for, the privacy practices or marketing activities of these third parties.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company’s established secure cloud-based data servers as well as any places where any third parties involved in such data processing are located, including Services Providers. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your Personal Data and other information is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your Personal Data and other information.
Disclosure of Your Personal Data
Your Use of the Service
During the course of Your use of the Service, certain Personal Data will be made available to others including:
- Sellers to whom you make an offer to purchase goods and services will receive Your user ID, rating and your city.
- Sellers from whom You choose to purchase goods and services in connection with Your use of the Service will be provided with your name, email address, physical address, phone number, and transactional information (based on Your use of the Service).
- Service Providers, including those third parties to whom You choose to engage in a transaction in connection with Your use of the Service and/or third parties using the Company’s Bravo Store Systems™ point-of-sale operating system software in connection with Your use of the Website and/or App.
- Other users of our Service may view your user ID, rating, city, profile (which includes multiple fields you may elect to fill out or leave blank).
Once You provide Personal Data to a Seller or other user through our Service, We have no control over how that information is used by that person. You should discuss any privacy concerns you may have with any person you meet through our Service as the only protection you will have is whatever terms you agree to directly with such person.
We may also disclose Your Personal Data to Our service providers for the purposes of third-party payment processing in connection with your usage of the Service. These third parties are authorized to use Personal Data as necessary to provide their services and in accordance with their own privacy policies and agreements with You.
We will also disclose Your Personal Data under circumstances where you express consent for Us to disclose Your Personal Data.
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public and/or law enforcement authorities (e.g. a court or a government agency), including in response to a subpoena, court order, or other legal process.

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

Personal Data Sold or Shared for a Commercial Purpose
Company does not sell Personal Data. Company may share Personal Data with third parties for commercial purposes as defined under applicable law, including with integrated service providers and partners, subject to this Privacy Policy.
Security of Your Personal Data
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.
Children's Privacy
The Service is not directed to children under the age of 13. We adhere to the Children’s Online Privacy Protection Act (COPPA) and will not knowingly collect Personal Data from any child under the age of 13. We ask that minors (under the age of 13) not use the Service. If a child under the age of 13 has provided us with Personal Data, a parent or guardian of that child may contact us and request that such information be deleted from our records.
Notice to California Customers
Under the California Consumer Privacy Act of 2018 (“CCPA”), California residents have certain rights around Our collection, use, and sharing of their Personal Data.
For purposes of the CCPA, as amended by the California Privacy Rights Act (“CPRA”), “sell” and “share” have the meanings set forth in applicable law. Company does not sell Personal Data in exchange for monetary consideration. Certain disclosures of Personal Data to third parties may constitute “sharing” under CPRA where such third parties use Personal Data for their own commercial purposes, including marketing their services, subject to their independent privacy policies.
You have the right under the CCPA and certain other privacy and data protection laws, as applicable, to opt-out of the sale or sharing of your Personal Data. If you exercise your right to opt-out of the sale or sharing of your Personal Data, we will refrain from selling or sharing your Personal Data where required by applicable law, unless you subsequently provide express authorization to do so. California residents may also opt out of SMS communications at any time by replying STOP to a text message, consistent with the opt-out rights described above.
Notwithstanding the foregoing, Company may continue to disclose Personal Data to service providers and integrated third-party partners as necessary to provide and support the Services, including payment processing, fraud prevention, communications, and customer support, consistent with applicable law.
Similarly, we do not offer financial incentives associated with our collection, use, or disclosure of your Personal Data.
We collect various categories of Personal Data when you use the Service, including identifiers, commercial information, internet or other electronic network or device activity information, geolocation data, and professional information. A more detailed description of the information We collect and how We use it is as well as the categories of third parties with whom we share Personal Data, and what information may be shared under different circumstances is provided above.
If you are a resident of California, you have the right to request to know what Personal Data has been collected about You, and to access that information. You also have the right to request deletion of your Personal Data, though exceptions under the CCPA may allow Us to retain and use certain Personal Data notwithstanding your deletion request.
Subject to certain exceptions set out below, on receipt and confirmation of a verifiable request from You, we will delete (and direct our service providers to delete) your Personal Data from our records.
Please note that we may not delete your Personal Data if it is necessary to:
- Complete the transaction for which the Personal Data was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
- Debug to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act;
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
- Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
- Comply with an existing legal obligation; or
- Otherwise use your Personal Data, internally, in a lawful manner that is compatible with the context in which you provided the data.
If you would like to exercise your right to deletion of your Personal Data, please:
- Go to the “My Account” tab in your account;
- Select the “Close your Account” tab;
- Read deletion instructions; check the box “I confirm that I want to permanently close my account and delete my data;”
- Select “Close my Account”; and
- Confirmation of account closure is required with authentication of your phone number. You must enter the security code sent via text message to confirm your account closure. If you do not have a phone number associated with your account, you will be prompted to enter your password instead.

Please note that you may only make a CCPA-related data access or data portability disclosure request twice within a 12-month period.
If you choose to contact us directly by email/in writing, you will need to provide us with:
- Enough information to identify you [(e.g., your full name, address and customer or matter reference number)];
- Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill); and
- A description that you are exercising your right to deletion and the information to which your request relates.
We are not obligated to delete any information if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf. Any Personal Data we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.
We will confirm receipt of your request within 10 business days. We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing, by mail or electronically, at your option. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We will not discriminate against You for exercising your rights under the CCPA.
Notice to Nevada Customers
Nevada law (NRS 603A.345) requires website operators to provide a way for Nevada consumers to opt out of the sale of certain information that the website operator may collect about them.
A detailed description of the information We collect and how We use it is as well as the categories of third parties with whom we share Personal Data, and what information may be shared under different circumstances is provided above. We may share or otherwise dispose of your Personal Data as defined under Nevada law. If You wish to submit a verified request not to sell “covered information” (as defined in NRS 603A.320) we have collected or will collect about you, You may contact us at the address or email noted below. Requests are subject to verification as provided in NRS 603A.345.
Notice to United Kingdom (“UK”) and European Economic Area (“EEA”) Customers
Transferring Your Personal Data Out of the EEA and UK (Applicable to EU and UK citizens only)
We control and operate the Website and/or App from within the United States of America. If You are accessing the Website and/or App from outside of the United States, please be aware that information collected through the Website and/or App may be transferred to, processed, stored, and used in the United States and other jurisdictions. Our online privacy practices are governed by the laws of the United States and the State of Nevada, which may differ from privacy laws in Your state or home country. By using the Website and/or App, You are expressly consenting to the transfer to and from, processing, usage, sharing, and storage of Your information in the United States and such other jurisdictions as set forth in this Privacy Policy.

The United States does not currently have the same data protection laws as the United Kingdom and EEA. We will, however, ensure the transfer complies with United States data protection laws and all Personal Data will be secure.

You also have the right not to be subject to a decision that concerns you or significantly affects you based solely on automated processing. To the extent permitted, a charge may apply before we provide You with a copy of any of Your Personal Data that we maintain.
Please note that we store information as necessary to fulfill the purposes for which it was collected, and may continue to retain and use the information even after a data subject request for purposes of our legitimate interests, including to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements. If You have any issues with our compliance, You may have the right to lodge a complaint with an EEA or UK government regulator if You are not satisfied with our response.
While we hope that we can resolve any query or concern you raise about our use of your Personal Data, the GDPR also gives you right to lodge a complaint with a supervisory authority in the United Kingdom or European Union (or European Economic Area) state where you work, normally live, or where any alleged infringement of data protection laws occurred.

Account Deletion
If you would like to exercise your right to deletion of your Personal Data, please:
- Go to the “My Account” tab in your account;
- Select the “Close your Account” tab;
- Read deletion instructions; check the box “I confirm that I want to permanently close my account and delete my data;”
- Select “Close my Account”; and
