Private Party Transfer - Items Left in Store
Learn how to manage private party transfer items that have been left in the store, including how to update item disposition and ensure compliance.
If a Seller/Transferor leaves a transfer item in the store at any time throughout the transfer process, that item is taken into the store's possession, and must be entered in the ATF A&D Book as an acquisition. As a result, there must also be a disposition for the ATF A&D Book, so the item must be released via an appropriate disposition method.
Once received, the item must be:
- Transferred to the Buyer/Transferee after the E4473 is accepted and NICS is approved (if necessary).
- Transferred to the Buyer/Transferee directly, if the Buyer/Transferee has an FFL.
- Returned back to the Seller/Transferor after an E4473 is accepted and NICS is approved (if necessary).
- Returned back to the Seller/Transferor directly, if the Seller/Transferor has an FFL.
- Sold to another buyer/transferee.
If returning the item back to the Seller/Transferor or selling/transferring to another buyer/transferee, you must cancel the transfer in the Third Party Transfers screen, then price the item from the Inventory screen and sell the item. The item can be priced/sold for $0.00 if necessary.
It is important that if you are selling/transferring the item to another buyer/transferee, the alternate buyer/transferee must not be participating in a straw purchase for the Seller/Transferor or the original Buyer/Transferee. Location Required for Transfer Items Left in Store Possession
When the item is taken into the store's possession, it must also be located in a warehouse location in the store. You will not be able to save the acquisition of the item until the item is located.
In the case where multiple items are left in store as a result of a delayed NICS response, the selected location will apply to all items on the E4473 which are left in the store's possession as the delayed response is indicated.
